Terms and Conditions

1. INTRODUCTION

1.1. This General Terms and Conditions (hereinafter referred to as the "Terms and Conditions") regulate the use of the Beauty Booking Mobile Application (hereinafter referred to as the "Platform", "Beauty Booking", or "We"), which is owned by Private Entrepreneur Ievgen Chugunov.

1.2. This Terms and Conditions, Privacy Policy and any other document posted on the Platform constitute and govern the contractual relationship between the User (hereinafter referred to as the "User" or "You") and the Platform.

1.3. Before accepting these Terms and Conditions, You are kindly requested to read them carefully. We also recommend You save or print these Terms and Conditions for Your own records. If You do not agree with any part of these Terms and Conditions, please do not accept them, create an account, or continue using the services provided on the Platform. Your continued use of the Platform will signify Your acceptance of these Terms and Conditions. These Terms and Conditions shall take effect from the moment they are published on the Platform.

1.4. The Terms and Conditions and the Privacy Policy will apply to You after Your acceptance and confirmation of the registration details during the creation of an account on the Platform. By accepting these Terms and Conditions and the Privacy Policy, You also acknowledge that You have read and accepted our Privacy Policy, which describes how Beauty Booking will collect, process and share Your personal information.

1.5. The text of the Terms and Conditions is in English and shall have legal force. The translation of the Terms and Conditions into any other language is provided for informational purposes only. In case of any inconsistency or discrepancy between the English text and any other language version, the English version shall prevail.

2. TERMS AND CONDITIONS AMENDMENT

2.1. Beauty Booking retains the right to periodically make amendments, additions, and/or changes to these Terms and Conditions. Beauty Booking will notify the User of any changes during their next login to the Platform and the User is required to review the amended Terms and Conditions. The User must not continue using the Platform unless they have accepted the updated Terms and Conditions.

2.2. Any amendments, additions, and/or changes to the Terms and Conditions shall take effect from the moment they are posted on the Platform. Therefore, it is recommended that Users regularly review the Terms and Conditions, as well as the rules and other information posted on the Platform.

2.3. If the User does not agree with the changes made to the Terms and Conditions, they have the right to terminate their agreement with Beauty Booking by ceasing to use the Platform and closing their account in accordance with the Privacy Policy and this Terms and Conditions.

3. ELIGIBILITY

3.1. The Platform and its services are only available to individuals who are at least 18 years old. By using the Platform, You confirm that You are 18 years or older. If We discover that a user under the age of 18 has accessed or used the Platform, We reserve the right to initiate immediately termination of the account.

3.2. Beauty Booking is not liable for any use of the Platform by individuals under the age of 18, if such use occurred with the consent or under the supervision of their parents or legal guardians. By allowing a minor to use the Platform, the parent or legal guardian acknowledges and accepts full responsibility for the minor's actions, including but not limited to compliance with these Terms and Conditions, any activities conducted through the account and any consequences arising from misuse of the Platform.

3.3. If You provide false information about Your age, You will be held solely responsible for any consequences arising from such misrepresentation.

4. ACCOUNT REGISTRATION AND SECURITY

4.1. To access certain features of the Platform, You will need to register and create an account using phone number or Apple ID or Google account. You are required to provide accurate and complete information when registering.

4.2. The Platform utilizes a Telegram bot to facilitate order confirmations or other notifications related to Services. Users acknowledge that certain transactions and interactions, including but not limited to booking confirmations and service verifications, may be conducted through the Telegram bot. It is the User's responsibility to ensure secure access to their Telegram account linked to the Platform.

4.3. You are responsible for maintaining the confidentiality of Your account credentials (username and password) and for all activities that occur under Your account. Beauty Booking is not liable for any unauthorized use of Your account resulting from Your failure to secure Your login credentials.

4.4. You agree to immediately notify Beauty Booking of any unauthorized use of Your password or account or any other breach of security. Beauty Booking cannot and will not be liable for any loss or damage arising from Your failure to comply with this requirement.

5. FREE ACCESS AND SUBSCRIPTIONS

5.1. The Platform offers both free and paid access to its services. Users can access the Platform for free with certain limitations, including restricted features, limited usage, or access to a subset of available services.

5.2. To unlock additional features and benefits, Users may subscribe to a paid plan. The details of available subscription plans, including pricing, features and billing cycles, are provided on the Platform.

5.3. By purchasing a subscription, You agree to pay the applicable fees and charges associated with the selected plan.

5.4. Subscriptions are billed on a recurring basis according to the plan selected at the time of purchase. Unless canceled, subscriptions will automatically renew at the end of each billing cycle under the same terms.

5.5. Users may cancel their subscription at any time through their account settings. The cancellation will take effect at the end of the current billing period and the User will continue to have access to the paid features until the expiration of their subscription term.

5.6. If a subscription payment fails due to insufficient funds, expired payment methods, or other issues, Beauty Booking reserves the right to transfer Your account to a free plan with the limitations specified in Clause 5.1. The subscription may be reinstated upon successful payment of the outstanding amount.

5.7. Beauty Booking may modify the subscription pricing or available plans at any time. Any changes will take effect upon renewal of the subscription.

5.8. If You subscribe to a paid plan via an app store or third-party provider, additional terms and conditions from that provider may apply. In such cases, cancellations and refunds may need to be processed through the respective app store or provider.

6. PROHIBITED CONDUCT

6.1. In addition to the restrictions outlined in these Terms and Conditions, You agree that You will not use the Platform to:

• Engage in any unlawful activity, including but not limited to the distribution, sale, or advertisement of illegal substances, drugs, or controlled items.
• Post, share, or promote any form of adult content, including material related to prostitution or any other illegal or immoral acts.
• Advertise, sell, or provide links to illicit goods, services, or activities, including but not limited to weapons, counterfeit products, or prohibited financial services.
• Engage in fraud, misrepresentation, or the sale of services/products that mislead or deceive customers, or that violate consumer protection laws.
• Promote or facilitate human trafficking, exploitation, or the solicitation of any illegal activities.
• Conduct any activity that violates the intellectual property rights of others, including the unauthorized use of copyrighted material or trademarks.
• Post any content that encourages, promotes, or incites violence, hatred, or discrimination based on race, ethnicity, religion, gender, sexual orientation, or any other protected characteristic.
• Violate privacy laws by posting, sharing, or using personal data of others without proper consent or authorization, or in breach of applicable data protection regulations.
• Engage in defamation, slander, or libel of other individuals or entities.
• Post content that is obscene, offensive, harassing, or in any way harmful to others or the reputation of the Platform.
• Use the Platform to create, distribute, or access malicious software (malware), spam, or phishing content designed to harm others or compromise their security.
• Offer or provide services or content that violate any local, national, or international laws or regulations, including criminal laws, civil laws and administrative offenses.
• Engage in any form of online harassment, bullying, or abuse toward other users of the Platform.
• Post or share content that compromises the safety or well-being of others, including unsafe beauty practices or unlicensed services.
• Use the Platform for unauthorized commercial purposes, including for pyramid schemes, multi-level marketing, or any other illegal financial structures.
• Engage in any activity that disrupts the operation of the Platform, including but not limited to attempts to hack, manipulate, or overload the Platform's infrastructure.

6.2. By using the Platform, You agree to respect the laws and regulations of the applicable jurisdiction(s) and the integrity of the Platform, ensuring that all activities conducted through the Platform comply with legal and ethical standards. Any violation of these rules may result in immediate suspension or termination of your account, in addition to any legal consequences that may arise from unlawful conduct.

6.3. You expressly acknowledge and agree that Beauty Booking may preserve and disclose Content or user information if required to do so by law, or if Beauty Booking believes in good faith that such preservation or disclosure is reasonably necessary to: (a) comply with legal processes; (b) enforce this Terms and Conditions; (c) respond to claims that any Content violates the rights of third parties; or (d) protect the rights, property, or personal safety of Beauty Booking, its users and the public.

7. CONFIDENTIALITY

7.1. You shall not disclose Beauty Booking Confidential Information. For the purposes of this Terms and Conditions "Beauty Booking Confidential Information" refers to all non-public information disclosed by Beauty Booking, its business partners, or their respective agents or contractors that is designated as confidential or that, by its nature or the circumstances of its disclosure, should reasonably be understood to be confidential.

7.2. Beauty Booking Confidential Information includes, but is not limited to:

In the sphere of statutory activity: information about efficiency of principal activity, information about development program and other commercial intentions, information about promising management technique, future organizational change, including organizational-legal form, future changes in organization of production, future staff changes, information on patterns of making decisions, mechanics of corporate appraisal, including those containing know-how of Beauty Booking.

In the sphere of finances: information disclosing target and actual figures of finance plan, value of property and its composition, bank transactions and operations, banking connections, specific of international settlements with contractors, debt obligations, loan facilities, finance instruments and facilities, inter alia amounts of money and partners, contractors etc.

In the sphere of partner management and authority relations and negotiations: information about financial agreements of Beauty Booking and its clients, contractors and business partners, information and knowledge about technological process, methods and technologies specific for the projects of Beauty Booking, lists of representatives, mediators, suppliers, customers, agents and other contractors, information about financial condition, standing and other data of contractors of the Beauty Booking, information about special terms and possibilities of collaboration, information about received orders and suggestions, information about the facts of preparation and conduct of negotiations, including information about negotiating persons, directives and methodologies on realization of negotiations, including the tactics, limits of powers, information about the measures taken before negotiations, patterns of defense of forms and documents, information on shareholders.

In the sphere of contracts and agreements: terms of payments and alternative settlement patterns, the expected volumes of commercial activity and development plans, information about conferences, financial and legal information on negotiations with other parties, inter alia contractors, partners whether future or current.

In the sphere of safety: information relating to old passwords and accesses used in the period of use of the Platform, information about the specifications of requirements of clients and contractors of the Beauty Booking, any electronic correspondence of the Beauty Booking, especially that containing a source code in compiled or uncompelled state, data of access and passwords to the electronic systems, data about economic and financial standing of the Beauty Booking and its clients and contractors, information representing the commercial secret of business-partners received on confidence basis.

In the sphere of marketing: information about methods and mechanisms of products, works, services advertising, information about methods and mechanisms of promoting of products, information about products, output and realization volumes, putting into production and turnover, methods of defense, promoting at the market etc.

In the sphere of the objects of intellectual property: any and all ideas, improvements, inventions, methodologies, works and other innovations of any kind, authored, conceived, contrived, developed, made or implemented by the Beauty Booking, whether or not eligible for copyright, patent, trademark, commercial secret or have any other legal protection (including formulas, manners, databases, mechanical and electronic hardware, electronic components, computer equipment and hardware, computer software and documentation, encoding technologies, production, advertising means, packaging and marketing technologies, marketing plans, plans for the new products, technical plans, business strategies, information regarding strategic alliances and partners, financial information, technical engineering data, methodologies and processes, forecasts, information regarding the Beauty Booking's personnel, customer lists, commercial secrets, product design, capabilities, specifications, information regarding potential and actual customers, information about the software development plan, information about future ideas, their realization in the sphere of software development.

8. INTELLECTUAL PROPERTY

8.1. Intellectual Property of the Platform.

8.1.1. All rights to the software, code, design, graphics, logos, databases, text and other elements used or posted on the Beauty Booking are the exclusive property of Beauty Booking and are protected by international intellectual property laws. None of these elements may be used without the prior written consent of Beauty Booking.

8.1.2. Beauty Booking grants Users a limited, non-transferable right to use certain elements of the platform, such as the interface or API, solely in accordance with this Terms. Any use beyond what is permitted by these terms requires separate authorization from Beauty Booking.

8.1.3. Users are prohibited from copying, distributing, modifying, or otherwise using the content of the platform without the prior written consent of Beauty Booking.

8.2. Intellectual Property of Users.

8.2.1. Users retain ownership of the content, including descriptions, images, videos, techniques, service listings, and other materials (collectively, "User Content") that they publish, upload, or post on the Platform. By posting User Content, Users grant Beauty Booking a non-exclusive, royalty-free, worldwide license to use, display, reproduce, distribute and modify such content solely for the purpose of operating, promoting, and enhancing the Platform, including in marketing materials and advertisements related to the services offered on the Platform.

8.2.2. Users represent and warrant that they have all necessary rights, licenses, and permissions to post their User Content on the Platform and that such content does not infringe upon any third-party intellectual property rights, including copyrights, trademarks, or patents. Users agree to indemnify and hold harmless Beauty Booking from any claims, losses, or damages arising from a violation of these rights.

8.2.3. Users may not post, upload, or publish any content that violates the intellectual property rights of others, including the unauthorized use of copyrighted materials, trademarks, or patented techniques. If a User posts content containing third-party intellectual property, they must have obtained the necessary permissions or licenses to do so.

8.2.4. Beauty Booking reserves the right to remove any User Content that infringes upon the intellectual property rights of others or violates any applicable laws or the terms of this agreement. Beauty Booking may, at its discretion, suspend or terminate the User's account for repeated violations of intellectual property rights.

8.2.5. By submitting User Content to the Platform, Users also grant other users of the Platform a limited, non-transferable license to access and view the content as part of their interaction with the Platform, in accordance with these Terms and the intended use of the Platform.

9. SUSPENSION AND TERMINATION

9.1. You agree that Beauty Booking may, at its sole discretion and without prior notice or liability to You, restrict, suspend, or terminate your access to part or all of the Services, and to any Content, if Beauty Booking believes you are using or have used the Services in violation of this Terms, applicable laws or regulations, or in any manner other than for their intended purpose and in accordance with all applicable guidelines and requirements.

9.2. Without limiting the foregoing, Beauty Booking may restrict or suspend your access to the Services for reasons including but not limited to: (a) requests from law enforcement or other government authorities; (b) unexpected technical issues or problems; or (c) if Beauty Booking reasonably believes that your account has been created fraudulently, accessed fraudulently, or used to commit fraud or for purposes other than its intended use in compliance with applicable requirements. Beauty Booking also reserves the right, but is not obligated, to terminate any account that remains inactive for an extended period, such as more than one year (where inactivity is defined by failure to log in to your account).

9.3. You agree that Beauty Booking will not be liable to you or any third party for any restriction, suspension, or termination of your access to the Services or Content.

9.4. Beauty Booking also reserves the right to pursue appropriate legal action against You for violations of intellectual property rights, fraud, or other reasons for termination.

10. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

10.1. The Platform and Services are provided on an "as is" and "as available" basis. Beauty Booking makes no representations or warranties of any kind, express or implied, regarding the operation or availability of the Platform or Services, or the information, content, materials, or products included on or otherwise made available through the Platform.

10.2. Beauty Booking does not warrant that the Platform or Services will be uninterrupted, secure, or error-free, or that defects will be corrected. Beauty Booking does not warrant the accuracy, completeness, or reliability of any content or information provided through the Platform.

10.3. To the fullest extent permitted by applicable law, Beauty Booking disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement.

10.4. In no event shall Beauty Booking, its affiliates, directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data or other intangible losses, resulting from: (a) Your use or inability to use the Platform or Services; (b) Any unauthorized access to or use of our servers and/or any personal information stored therein; (c) Any interruption or cessation of transmission to or from the Platform; (d) Any bugs, viruses, Trojan horses, or the like that may be transmitted to or through the Platform by any third party; (e) Any errors or omissions in any content or information provided through the Platform.

10.5. BEAUTY BOOKING IS NOT RESPONSIBLE FOR THE QUALITY, SAFETY, LEGALITY, OR RESULTS OF ANY SERVICES PROVIDED BY USERS THROUGH THE PLATFORM. ANY INTERACTIONS, AGREEMENTS, OR TRANSACTIONS BETWEEN USERS, INCLUDING THE PROVISION OF BEAUTY SERVICES, ARE SOLELY BETWEEN THE INVOLVED PARTIES. BEAUTY BOOKING DOES NOT ENDORSE, VERIFY, OR GUARANTEE THE QUALITY OR OUTCOMES OF ANY SERVICES OFFERED ON THE PLATFORM AND SHALL NOT BE HELD LIABLE FOR ANY DISSATISFACTION, DAMAGES, OR LOSSES RESULTING FROM SUCH INTERACTIONS.

11. INDEMNITY

11.1. You agree to indemnify and hold Beauty Booking, its subsidiaries, affiliates, officers, agents, partners and employees harmless from any claim, demand, or action, including reasonable attorneys' fees, arising out of or related to: (a) Content you submit, post, or otherwise make available through the Platform; (b) Your use of the Platform or Services; (c) Your violation of these Terms and Conditions or any other applicable terms, policies, or guidelines published by Beauty Booking; (d) Your violation of any rights of a third party.

11.2. This indemnification obligation will apply to the fullest extent permitted by law and will survive the termination of your use of the Platform.

12. LINKS TO THIRD-PARTY WEBSITES

12.1. The Platform may contain links to websites operated by third parties. These linked sites are not under the control of Beauty Booking and Beauty Booking is not responsible for the content or practices of any other Internet sites linked to the Platform. The inclusion of any link does not imply Beauty Booking's endorsement of the linked site or its content. Beauty Booking expressly disclaims all liability for any loss or damage resulting from your access to or use of any linked websites.

12.2. Links to third-party sites are provided solely for your convenience. Access to these sites is at your own risk and Beauty Booking makes no representations or warranties regarding the content or accuracy of any third-party websites.

13. CLAIMS AND NOTIFICATIONS

13.1. If you have a complaint regarding the operation of the Platform, you should promptly contact our customer service team at info@beauty-booking.biz., providing detailed information about the nature of your complaint. We will make every effort to address and resolve your issue as soon as possible, typically within 10 business days. In certain cases, we may extend the resolution period by an additional 10 business days if necessary.

14. ASSIGNMENT

14.1. Beauty Booking reserves the right to assign or transfer its rights and obligations under these Terms and Conditions, in whole or in part, to any individual or organization without requiring the User's consent, provided that such assignment does not negatively affect the User's rights or benefits under these Terms and Conditions. The User may not assign or transfer any rights or obligations under these Terms and Conditions to any third party in any manner.

15. GOVERNING LAW AND JURISDICTION

15.1. These Terms and Conditions are governed by the laws of Ukraine.

15.2. Any disputes that may arise on the basis of these Terms and Conditions are to be considered in the courts of Ukraine. The Platform cannot be held responsible for the legislation of other countries.

16. DISPUTE RESOLUTION

16.1. Upon receiving a dispute, our Customer Support Team will initiate an internal review of the matter in a timely manner (within 48 hours). Be notified some issues may take more time up to 30 calendar days. We will keep the involved parties informed of the progress of the investigation and any relevant updates during the resolution process. Based on the review, we will propose a resolution that aims to be fair and in accordance with our Terms and Conditions.

16.2. Any dispute, controversy or claim arising out of or in relation to our Terms and Conditions, or violation, termination or invalidity thereof, shall be transferred to the exclusive jurisdiction of Ukraine.

17. CIRCUMSTANCES OF INSUPERABLE FORCE

17.1. Beauty Booking shall not be held liable for any failure or delay in fulfilling its obligations under these Terms and Conditions if such failure or delay is caused by circumstances of insuperable force. Insuperable force circumstances include, but are not limited to, natural disasters, wars, civil unrest, disruptions in public communication networks or services, industrial disturbances, DDOS attacks, and similar internet disruptions that may have adverse effects ("Force Majeure").

17.2. During the period of Force Majeure, Beauty Booking's obligations shall be suspended, and the performance of such obligations shall be delayed. Beauty Booking will make reasonable efforts to mitigate the impact of the Force Majeure and resume the fulfillment of its obligations as soon as possible.

18. SEPARABILITY OF THE PROVISIONS

18.1. If any provision of these Terms and Conditions becomes invalid, illegal or at any degree lost its legal efficacy, such provision shall be separated from the remaining provisions of these Terms and Conditions and the remaining provisions shall remain in full force and effect. In such cases, the part that is considered invalid varies according to the applicable law.
